People might consider this when making vacation plans for a cruise.

But Graham also ruled that the company did not breach its contract with passengers, agreeing with Carnival's argument that when passengers bought a ticket, they were never promised a safe voyage at all, which may come as a big surprise to future cruise passengers.

"The contract ticket makes no express guarantee for safe passage, a seaworthy vessel, adequate and wholesome food, and sanitary and safe living conditions," wrote Graham. The ruling reflects the little protections afforded to passengers as currently written by many cruise ship companies.

While the cruise turned out to be a disaster for all, lawsuits are ridiculous in this situation.

Naturally, everyone got their money back and was made whole - either by the cruise line or their own travel insurance.

A very disgusting experience but to get hundreds of thousands of dollars for the experience is not going to happen nor should it happen.

Too many people just want to be compensated in ridiculous amounts and too many sleazebag lawyers willing to file the lawsuits - for their 35-50% - of any payout.

As far as considering the ruling before taking your next cruise, remember how many millions of people take a cruise each year and how many are affected by this type of disgusting experience.

Are you making statements you know to be fact, or just spouting off an uniformed opinion?

Nevertheless, I thought, the parts of the quote I highlighted in Bold type were interesting.

I agree with what buggyone said.

I wonder if anyone would decide not to go on a cruise if they did realize they were not promised a safe voyage. Can't imagine it would stop anyone, but that's just my opinion.

Wow! I cannot express my thoughts on a subject without being verbally attacked?

The parts in bold were interesting. However, look at any transportation ticket. Do any guarantee a safe trip? We take the trip based on faith and past practices it will be safe, don't we?

Yes, I do know passengers were made financially whole.

Default Should be compensated.

I agree that there are too many frivolous lawsuits these days but I do believe that the passengers should be compensated for having to live in such horrible conditions for days. Put yourself in their position for just one day. Can you imagine feces spilling out of the rooms? How about the smell in the hot weather....no air conditioning? Even if they got a small amount of say 5,000 each. They did have mental and physical anguish and should be compensated for it. I never knew that the cruise line was not responsible for providing a safe passage, food or a ship that was in good repair. It gives one a lot to think about before taking a cruise.

The passengers on the cruise were well compensated and do not deserve anything additional. Their lives were not endangered. The passengers from Flight 1549 - Hudson River landing got compensated for the flight and their possessions but did not get a penny more in frivolous claims.

Big difference in the two events so no way to relate the two. The plane went down due to bird strikes. There was never an allegation of negligence against the airline or crew. The cruise ship incident has allegations of negligent maintenance and the judge in the case has already ruled the cruise ship line was negligent so the only issue left to resolve is damages.

We are getting ready to take our 53 cruise in May.
I agree with Buggyone and In Awe Of TV.
Yes, I'm sure it was a horrible experience that I hope I never have to go through, but I think they were compensated enough.
