Default Roofing Insurance Fraud - AOB Scams - May/June 2024

Friendly Suggestion from SkyLight Roofing Villages (May-June 2024):

We spent these last two-months assisting dozens of Villagers (Names won’t be mentioned respectfully) that have been stuck in litigation fraud for almost 6-months to a year because they signed an agreement for a “Free Roof” (minus deductible at times), but failed to realize that these solicitors in The Villages and surrounding communities are “siphoning” your insurance policy (through attorneys) for everything that is built within and making you a future liability to any carrier left in Florida.

You also may not fully realize the repercussions of one-way attorney fees in 2024 until later down the road. Don’t be a fool to this please. They will tell you there is false-damage (wind damage, hail-damage, zippering, brittle, etc). It’s simply called FRAUD and a falls under SCAM category here in Florida.

“If you see or hear someone from named roofing company in The Villages selling you (soliciting you) on the idea that they can attain your roof replacement based on an insurance claim when it’s not claimable - PLEASE tell them to leave!

Or if you are asked to sign something to have roof inspected - Tell them “NO” and to politely leave!

This is still happening in portions of the various local communities in The Villages folks and all of us have a voice.”

According to the FBI 2022 Internet Crime Report, Florida ranked second in the United States with 42,792 victims who lost $844 million trailing only California in both categories.

Red Flags to spot and stay away from:

#1 Unsolicited: The scammers contact you by phone or email.

#2 Unsolicited: knock on your front door.

“An avalanche of lawsuits fueled by roofing scams from 2017-2023 has plunged Florida into a property insurance crisis that has forced two-dozen companies to shut their doors, drop customers, raise rates or flee the state. It’s a slow-motion collapse that lawmakers have known about for years but have failed to fix unfortunately.

The mess has made it harder for people to protect their homes in a state that is frequently battered by high winds, hard rains, heavy barometric activity and is increasingly vulnerable to climate change. Things could get worse if the state is hit by a major hurricane into 2025, where we will find these issues surmounting.

As most of us know, the scam (Insurance scams) works like this:

Contractors knock on doors offering to inspect homeowners’ roofs for storm damage. They say they can help get a roof replacement covered by insurance, and they persuade the homeowners to sign away their rights to file the claims themselves. The contractors then file fraudulent damage claims, and when the insurance companies balk, the contractors sue. The insurance companies usually settle the disputed claims for many times more than the original claim. Most of that money goes to the contractors’ lawyers in the form of a “contingency fee multiplier.” Some lawyers file hundreds of such lawsuits a year. You will now (personally) be liable for attorneys fees into 2025 based on legislative criteria.

The homeowner may feel like they get a free roof (minus deductible), but everyone will pay for it through increased rates for years to come.

Ultimately, the victim is every Floridian who is buying their neighbors’ roof and those folding under the pressure or who are being seduced will also be red flagged on ILB (FL Insurance Risk Liability Profile) in 2024-2025.”

Well stated, I will add I thought Florida passed a law to block AOB assignments, but maybe it has not become effective yet.

Default I agree with Village Tinkerer What happened to The New Law Florida's Senate Bill 2-A

Florida's Senate Bill 2-A, signed into law by Governor Ron DeSantis on December 16, 2022, prohibits property owners from assigning their insurance benefits to third parties for work done on their property after January 1, 2023. This means that property owners are responsible for all claim activity, from submission to payment.

Were your customers scammed before Jan 1 2023? Do you believe that the new law is/will be effective to eliminate AOB scamming?

Default roof scam

Just yesterday I answered the door and it was a so called free inspector from Ap?? roofing letting me know that I could still get a free roof.

Does anyone know when this law actually went into effect—- within the past eight months, TWO houses that I’m aware of, have gone through this insurance paying for roof scam?

One which I won’t mention came to my house five times with their pitch I can get you free roof. I told them to get off my property and shut the door.


I call them the 3 tab hunters. I’d you still have three tab roof you can hear the brakes slammed on where the pass your house. IMO In my area about 70% of roofs was replaced due to scam. In 2020/2021 and 2022 it forced rest of us to get our perfectly good old roof replaced due to outrageous insurance quotes or wouldn’t insure. Then state stepped in too little and too late after 90% of roofs was replaced. I still see about 10% 3 tab roofs left. How they got insurance is beyond me. Few are empty and probably in probate? IMO scam with architecture roof was worse, most was just stained. But, feasco was good for roofing companies cause insurance forces perfectly good old roofs to get replaced. So by time get all roofs replacement done the merry go around comes around again.

SB-2A also significantly changes assignments in Florida as an assignment agreement must be executed under a residential or commercial property insurance policy on or after July 1, 2019, and before Jan. 1. Effectively, an insured will not be able to assign any rights under a residential or commercial property policy beginning in 2023.

Any attempt by an insured to assign post-loss property insurance benefits under a policy after Jan.1 will be void, invalid, and unenforceable. However, this prohibition of assigning post-loss insurance benefits may not apply to surplus lines insurers. It does not specifically state that it applies to a surplus lines insurer.

Now I have no idea what a "surplus lines insurer" is....

Default Loophole that the scammers Roofing Co, and their Legal cohorts are exploiting??

Further to my Post # 3 and VT post #7, Surplus Lines Insurer may be the loophole that the Scammers are exploiting. Skylight Roofing what is your information on this since you made the original statements about scamming still happening for Roofs.

We would appreciate your advice on what caused the AOB problems for your Customers and whether Senate Bill 2A has or will solve AOB problems.

The simplest solution for the AOB problem is DO NOT SIGN the form no matter what the person says.

Surplus lines insurance are insurance companies which do not need to follow all Florida regulations and are not backed up by FIGA (back up insurance for non surplus lines carriers). Lloyds of London is a surplus lines carrier.
